Giveaway Terms

Please read through all rules before entering TruKid’s ("Sponsor") Promotion. We reserve the right to change these terms at any time, and you agree to abide by the most recent version of these terms (“Terms”). Do not participate in this Promotion if you do not agree to all the Terms.
This Promotion is defined as is outlined in the contest/giveaway announcement.
No purchase necessary to enter or win. A purchase does not increase the chances of winning.
Eligibility and Restrictions:
This promotion is open only to legal residents of which is the 50 United States, and the District of Columbia. You must be over 13 years of age at the time of entry to submit an entry. There is a limit of 1 winner per household.
Employees, officers, and directors (including immediate family members and members of the same household of such persons, including common law spouses) of the Sponsor, its participating sponsors, partners, and parent company, affiliated companies or agents, their respective advertising or promotional agencies (collectively, the “Promotion Entities”) are not eligible to win.
How to Enter:
Participants must follow instructions outlined in the contest/giveaway announcement in order to qualify.
Entries must not contain profanity, threats, hate speech, or bullying. If your submission is a little risqué, please choose a more PG-rated 2nd option for this Promotion.
Only entries posted on or after the official promotion start date will be counted.
Entries/comments must NOT:
- Have been copied, in whole or in part, from any other work.
- Contain material that, in the sole discretion of Sponsor:
- Disparages any person or disparages any of the Promotion Entities or, any of their respective affiliates, any of its competitors, or any of their respective products or services.
- Violates or infringes upon the intellectual property or other rights of any third party.
- Includes any third party trademarks, logos, or brand names
- Is hateful, tortuous, defamatory, slanderous, or libelous.
- Promotes bigotry, racism, sexism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Contains any personal information, including, without limitation, name, address, e-mail address, or phone number.
- Uses the names, likenesses, or other indicia identifying any other person, living or dead.
- Promotes alcohol, illegal drugs, tobacco, or firearms/weapons (or the use of any of the foregoing).
- Promotes any activities that may appear to be unsafe, dangerous, or unlawful.
- Is unlawful.
- Contains any nudity or any sexually explicit, lewd, offensive, disparaging, or other inappropriate content.
- Communicates messages or images inconsistent with the positive images and goodwill with which TruKid wishes to associate
Winner Selection and Notification:
This promotion states that a “random” winner(s) will be chosen. A random number generator will be utilized to select the potential winner(s). The order of entries is based on how they appear on Instagram.com on the date the winner is chosen.
Winner will be notified through comments or direct message. If we do not hear from you within 2 days we will choose a new potential winner.
By participating in this Promotion, each participant and winner waives any and all claims of liability against the Promotion Entities and each of its employees and agents, promotion’s sponsors and their respective employees and agents, including any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize.
Privacy:
Sponsor will not share your private information with any third party or publicly. The only information that will be shared is your name and/or social media handle at time of winner announcement or in any subsequent sharing of your original work submitted.
Prizes:
Winner(s) will receive the prize outlined in the contest/giveaway announcement. We reserve the right to substitute prizes if necessary. The specifics of the prize shall be solely determined by Sponsor. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. The Sponsor shall have no liability for winner’s failure to receive prize due to lost mail, or for winner’s provision of incorrect mailing address.
Participation:
By participating in this Promotion, each participant and winner waives any and all claims of liability against the Promotion Entities and each of its employees and agents, promotion’s sponsors and their respective employees and agents, including any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize. By participating in this promotion you acknowledge that this is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Pinterest, Twitter or YouTube. You completely release Instagram, Facebook, Pinterest, Twitter or YouTube of responsibility regarding the outcome of any promotion.
Terms & Conditions:
Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend any contest/giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the contest/giveaway. In such case, Sponsor may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the campaign or website or violates these Terms & Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the contest/giveaway, to void votes for any reason, including but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by contest/giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest/giveaway may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability:
By entering, you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the contest/giveaway and/or his/her acceptance, possession, use or misuse of any prize or portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone or Internet service; (iv) unauthorized human intervention in any part of the entry
Disputes:
All Sponsor contests/giveaways are governed by the laws of the United States of America and California, without respect to conflict of law doctrines. As a condition of participating in any Sponsor contest/giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with a contest/giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Georgia having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering the contest/giveaway). Participant further waives all rights to have damages multiplied or increased.
